  • Developer seeks remaining escrow funds because buyer did not follow right to repair statute. Buyer seeks substantial repairs for defects discovered within days of close of escrow.
  • Bank induced borrower to refinance of a higher interest rate, then refused to modify loan because borrowers were current. Borrowers waited too long to sue while they searched for options.

Business

  • Relative sold restaurant/deli to family members. The deal closed three days before shutdown due to the pandemic. Buyers did not perform in full. Seller had police remove buyers from restaurant due to their threats of violently destroying business. Buyer sued for breach of contract, fraud, non-payment of sales tax. Sellers cross-complained for wrongful eviction, alleging that they were only one payment behind on the sales contract, and their application for change of ownership and attendant changes to tax reporting had not been processed by the state due to pandemic shutdowns, and they should not have been locked out. Since the parties were relatives, the matter was settled.
  • Parties litigated the question of whether a forbearance agreement is a separate credit document subject independently to the usury laws, when the underlying note and extensions were under one of the exceptions to the usury law, but the forbearance agreement itself lacked the hallmarks of that exception.
  • Two people met in a Japanese internment camp. Eighty years later, one lent the other one's son over 1 million dollars to start a business. No amounts have been repaid.
  • Experienced tradesman provided labor - his own and others'- at the request of a subcontractor on a public works project. The first week was paid for. The second week, the subcontractor did not appear, and tradesman provided the work directly, without contract and without his own license. Contractor payed subcontractors, but not the un-contracted, unlicensed laborers. Tradesman sued to recover for all unpaid labor, as a contractor not as a laborer.

Family Law

  • Settled a case in which a couple disputed rights to properties, five of which were in Mexico, along with disputes over personal property and vehicles.

Insurance

  • Settled a case where employee fell while employer was remodeling. Employee settled with employee and sought compensation from floor installer. Installer claimed that control of the premises was exclusively handled by employer, and area was off-limits during construction.
  • Settled a case in which an insurance company denied a claim based on fraud. The claimant was Ghanaian and the theft occurred in Ghana.

Landlord/Tenant

  • Settled a case where plaintiffs, African-American Lesbian couple, were denied an apartment application after telling landlord they had a daughter. Landlord said the limit for the 2 Bedroom apartment was 2 people. Landlord then rented to 3 adults, 2 White, 1 Korean-American.
  • Plaintiff neglected to pay rent on a regular basis. Landlord issued 3-day eviction notices every month on the second of the month to generate an eviction of the rent-controlled apartment. Tenant sued landlord for harassment. Case settled for $75,000.
  • Landlord failed to provide CC+Rs to tenant upon lease and failed to tell tenant that HOA enforced every detail of CC+Rs. After move-in, a landlord repeatedly visited tenant, sometimes entering the garage to talk to tenant about violations of rules.

Personal Injury

  • During a nuisance abatement action, a concealed gun went off, injuring a worker. No person pulled the trigger, and no person knew of the actual presence of the gun. There had been possible previous contraband on the premises, and a police officer was on "civil standby" during the incident. Injuries were not major but the effect was lasting.

Probate, Estates & Trusts

  • Successfully resolved contested probate matter where a decedent's children claimed that amendments to their father's will and trust shortly before his death were accomplished by his second wife's undue influence.
  • Settled a case involving a dispute over apportionment of family home and reimbursement of trust and out of pocket expenses.
  • Resolution of dispute among adult heirs of parents' estate, valuation of ongoing accounting business; and distribution of profits.

Real Estate

  • Plaintiff Buyer bought a large parcel of land in a desirable location, with the intent to subdivide. Seller had listed the parcel with a real estate professional, who took the lot size from the assessor's records and made the usual indications that buyer should verify independently if it was a concern. Assessor's records, while having the correct measurements, were substantially and meaningfully off on the computation of the square footage. (The computation gave the square footage more than 12,000 square feet over the actual amount.) Plaintiff discovered the discrepancy when they tried to subdivide. Neither the seller nor the agents, nor the buyer, had any knowledge that the square footage of the lot was wrong.
  • One party took title to property, with the loan in his name, to facilitate purchase of a home by another party. They then turned title into tenancy in common. Initial facilitating party made no payments but received all tax benefits. Paying party sued to transfer title solely to him as he now could obtain full financing.
  • 93-year-old seller was in contract to sell his house when a "flipper" - approached by seller - offered with less money "all cash - quick close". When seller's agent didn't cancel prior sales contact, flipper sued.
  • Plaintiff bought a building but not business. Seller's certificate of occupancy was not final, but seller thought it was finalized. City did not flag issue or follow up after buyer took ownership, city did not permit intended.
  • Husband sued estate of wife and executor/step-daughter for misappropriation, breach of contact. Duty and elder abuse. Step-daughter claimed plaintiff conveyed all his interest in the family home to deceased wife and took funds from joint account.
  • Parties bought properties together but didn't put both names on a title. Non-titled owner withheld collected rents to force titled owner to amend title. Instead, titled owner transferred properties to a trust she created, then sued for damage to trust assets
